By making a booking with Pulau Drift — whether via our website, by phone, or by email — you confirm that you have read, understood, and agree to be bound by these Terms and Conditions on behalf of yourself and all Guests in your party.

You must be at least 18 years of age to enter into a booking agreement with us. Minors may participate in a charter only if accompanied by and under the responsibility of a booking adult.

3. Our Services

Pulau Drift provides private yacht charter experiences in Singapore's waters, including but not limited to:

Service availability is subject to vessel scheduling, weather conditions, and maritime authority requirements. We reserve the right to adjust routes, activities, or itineraries where safety or conditions require it, without constituting a breach of this Agreement.

4. Booking Process

All bookings are subject to availability and confirmation by Pulau Drift. A booking is considered confirmed only when we issue a written confirmation (by email or message) and the required deposit has been received.

5. Payment Terms

All prices are stated in Singapore Dollars (S$) and are inclusive of applicable taxes unless otherwise stated.

6. Cancellation and Rescheduling

We understand that plans can change. The following terms apply:

Weather cancellations: If we cancel a charter due to adverse weather or maritime authority direction, we will offer a full reschedule or a credit note valid for 12 months. Cash refunds are issued at our discretion in such cases.

7. Charter Conduct

To ensure a safe and comfortable experience for everyone on board, all Guests agree to:

The Skipper has full authority over the vessel and may, in their sole judgment, alter the itinerary, restrict activities, or terminate the charter early if safety or conduct warrants it. No refund is provided for early termination due to Guest misconduct.

8. Safety and Compliance

All charters operate in accordance with the Maritime and Port Authority of Singapore (MPA) regulations. Pulau Drift holds all required licences and insurance for commercial pleasure craft operations in Singapore waters.

9. Liability and Indemnification

Pulau Drift carries third-party liability insurance in accordance with MPA requirements. However, to the fullest extent permitted by Singapore law:

By joining a charter, each Guest accepts the inherent risks associated with maritime activities and agrees to indemnify Pulau Drift against claims arising from their own negligence or failure to follow Crew instructions.

10. Intellectual Property

All content on this website — including text, images, and design — is owned by or licensed to Pulau Drift. You may not reproduce, distribute, or use any part of this content without our prior written consent.

Photographs and videos taken during your charter are for personal use only. You may share them on personal social media, but commercial use or sale of such media is not permitted without our written approval.

11. Privacy

Your personal data is handled in accordance with our Privacy Policy and Singapore's Personal Data Protection Act 2012. By making a booking, you consent to the collection and use of your data as described therein.

12. Disclaimers

Our services are provided in good faith and based on our professional experience. We make no representation that any specific fish species will be caught during a fishing charter, or that specific anchorages will be accessible on any given day, as these are subject to conditions beyond our control.

Nothing in these Terms limits any rights you may have under the Singapore Consumer Protection (Fair Trading) Act or other applicable legislation.

13. Termination

Either party may terminate a booking prior to departure by providing written notice. Client-initiated termination is subject to the cancellation policy in Section 6. We may terminate a booking if we reasonably determine that proceeding would present a safety risk, or if the Client has breached these Terms.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of Singapore. Any disputes arising under this Agreement shall first be referred to good-faith negotiation between the parties.

If resolution cannot be reached within 30 days, either party may refer the dispute to the Singapore Mediation Centre or the Small Claims Tribunal (where applicable), before commencing formal legal proceedings in the courts of Singapore.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be published on this page with a revised "Last Updated" date. For bookings already confirmed, the version of these Terms in force at the time of confirmation applies unless we notify you of material changes and obtain your agreement.
